In consideration of Fitchimp, Inc. ("FITRANKINGS") allowing you, or your user or account holder (collectively, "Participant") to participate in the AI Services, the Participant agrees to the following terms and conditions ("AI Services Terms") for the AI Services.

PARTICIPANT HEREBY REMISES, RELEASES, ACQUITS AND FOREVER DISCHARGES FITRANKINGS, ITS SUCCESSORS, ASSIGNS, SHAREHOLDERS, OFFICERS, DIRECTORS, AND AFFILIATES (COLLECTIVELY ALSO “FITRANKINGS”) OF AND FROM ANY AND ALL LIABILITIES, CLAIMS, REMEDIES, DEMANDS, SUITS OR CAUSES OF ACTION OF WHATSOEVER KIND OR CHARACTER, IN WHOLE OR IN PART, WHETHER CHOATE OR INCHOATE, WHICH PARTICIPANT MAY EVER HAVE AGAINST FITRANKINGS THAT IN ANY WAY DIRECTLY OR INDIRECTLY RELATE TO, RESULT FROM, ARE BASED UPON, OR ARISE OUT OF THE AI SERVICES. FITRANKINGS DISCLAIMS ALL REPRESENTATIONS AND EXPRESS AND IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT THE FOREGOING RELEASE IS NOT PERMITTED BY APPLICABLE LAW, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FITRANKINGS SHALL NOT BE LIABLE IN CONNECTION WITH THE AI SERVICES FOR (i) ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL, INDIRECT, EXEMPLARY OR PUNITIVE DAMAGES, AND (ii) NOTWITHSTANDING ANY AGREEMENT TO THE CONTRARY, ANY DAMAGES IN THE AGGREGATE EXCEEDING TEN DOLLARS ($10) IN CONNECTION WITH THE AI SERVICES, EVEN IF SUCH PARTY WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.

The AI Services are provided “AS IS” for informational purposes only. The AI Services may include certain information, reference guides, videos, and databases which are not appropriate for Participant's individual case. The information provided by the AI Services also may contain errors, technical inaccuracies or typographical errors. Participant should always exercise their own judgment for any given situation and with regard to any information provided by the AI Services.

In addition, this information is not intended or recommended as a substitute for professional medical, health or fitness advice. Before starting any physical activity, check with your health care provider. The AI Services are not intended to give and do not give professional medical advice. Always seek the advice of your physician or other qualified health care provider regarding any health or medical condition or treatment.

As between Fitrankings and Participant, Fitrankings is the owner of all information and data provided by, or derived in connection with, the AI Services, including but not limited to any artificial intelligence system or machine learning models. To the extent that use of Participant's data gathered by Fitrankings would require a license, Participant hereby automatically and forever grants such license to Fitrankings.

Participation in the AI Services is subject to an account in good standing and Participant continues to be subject to the Fitrankings Terms of Service or other governing agreement ("Agreement") in addition to these AI Services Terms. In the event of a conflict between the terms and conditions of these AI Services Terms and the Agreement, the terms and conditions of the AI Services Terms shall control. Information provided by the AI Services and these AI Services Terms may be changed or updated without notice. Fitrankings may also make improvements and/or changes in the AI Services or the products and/or services in connection therewith at any time without notice. Posting of the new AI Services Terms on this page shall constitute notice and your continued use of the AI Services constitutes Participant's agreement to the changed or updated AI Services Terms.
